1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and SpectrumThrive Inc. ("SpectrumThrive," "we," "us," or "our"), governing your access to and use of the SpectrumThrive platform, website, and services (collectively, the "Service").

By accessing or using SpectrumThrive, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

2. Use of the Service

SpectrumThrive is designed to provide personalized support and guidance for neurodivergent adults, particularly autistic individuals. The Service is provided on an "as-is" basis and is currently in beta.

You agree to use the Service only for lawful purposes and in a way that does not infringe upon the rights of others or restrict their use and enjoyment of the Service. Prohibited behavior includes:

• Using the Service to harass, threaten, or harm any individual or group
• Attempting to gain unauthorized access to the Service or its systems
• Disrupting the normal flow of dialogue in interactive sections of the Service
• Transmitting any viruses, worms, or malicious code
• Using the Service for commercial purposes without explicit written consent

3. User Accounts

To access certain features of the Service, you may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You agree to provide accurate, current, and complete information when creating your account. You also agree to promptly update your account information if it changes.

If you believe your account has been compromised, you must notify us immediately at privacy@spectrumthrive.com.

4. Acceptable Use Policy

You agree not to use the Service in any manner that:

• Violates any applicable law, regulation, or ordinance
• Infringes on the intellectual property rights of others
• Constitutes spam, phishing, or social engineering
• Involves the transmission of illegal content or materials
• Attempts to modify, reverse-engineer, or circumvent the Service
• Uses the Service to impersonate another person or entity
• Scrapes, crawls, or otherwise automates access to the Service without permission

5. Intellectual Property Rights

All content on the SpectrumThrive platform—including text, graphics, logos, images, and software—is the property of SpectrumThrive or its content suppliers and is protected by international copyright and trademark laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes. You may not reproduce, distribute, modify, or transmit any content without prior written permission from SpectrumThrive.

Any feedback, suggestions, or improvements you provide to SpectrumThrive may be used by us without restriction or compensation.

6. AI-Generated Content Disclaimer

Important: The guidance, support, and recommendations provided by SpectrumThrive are not a substitute for:

• Professional medical advice, diagnosis, or treatment from licensed healthcare providers
• Professional mental health counseling or therapy
• Legal advice from qualified attorneys
• Crisis intervention or emergency mental health services

If you are experiencing a mental health crisis or emergency, please contact a licensed mental health professional or emergency services in your area immediately. SpectrumThrive does not provide crisis support.

7. Limitation of Liability

To the fullest extent permitted by law, SpectrumThrive shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses.

In no event shall SpectrumThrive's total liability exceed the amount you have paid to SpectrumThrive in the 12 months preceding the claim, or $100, whichever is greater.

8. Disclaimer of Warranties

The Service is provided "as-is" and "as-available" without warranties of any kind, either express or implied. SpectrumThrive disclaims all warranties, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose
• Warranties of non-infringement or title
• Warranties regarding the accuracy, reliability, or completeness of the Service
• Warranties that the Service will meet your requirements or expectations

You assume all risk and responsibility for your use of the Service.

9. Termination

SpectrumThrive may terminate or suspend your account and access to the Service at any time, with or without cause, and with or without notice. Reasons for termination may include:

• Violation of these Terms
• Engagement in illegal or harmful activity
• Discontinuation of the Service or certain features
• Business or technical reasons

Upon termination, your right to use the Service immediately ceases. Data associated with your account may be deleted or retained at SpectrumThrive's discretion.

10. Changes to These Terms

SpectrumThrive reserves the right to modify these Terms at any time. We will notify you of any material changes by updating the "Last updated" date at the top of this page.

Your continued use of the Service following the posting of revised Terms means that you accept and agree to the changes.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Maryland, United States, without regard to its conflict of laws principles. Any legal action or proceeding related to these Terms shall be brought exclusively in the state and federal courts located in Maryland.
